Export Compliance Management
Under the Regulations of the People’s Republic of China on Export Control of Dual-Use Items and Ministry of Commerce Announcement 2024 No. 51, radar products with sensitive technical characteristics such as long-range detection, low-altitude surveillance, and multi-target tracking (subject to control code 6A108.a) must obtain an export license from the Ministry of Commerce before export. The buyer must provide verified end-user and end-use certificates and issue a non-re-export/non-transfer undertaking. Violations of these requirements may result in suspension of business for rectification, substantial fines, and criminal liability in accordance with the law.
Since the second half of 2025 and into 2026, the relevant Chinese authorities have continued to intensify enforcement against illegal exports of dual-use items. The scale and scope of enforcement have reached record levels, penalty standards have increased significantly, and enforcement measures have expanded from traditional port inspections and seizures to digital trade monitoring, end-user verification, and post-export traceability. The following authorities play core roles in relevant enforcement actions:
- Ministry of Commerce (MOFCOM): Responsible for accepting and approving export license applications for dual-use items, and for pursuing legal liability for exports without a required license or misrepresentation of end use.
- General Administration of Customs (GACC): Conducts inspections and seizures of non-compliant dual-use export shipments at ports nationwide in accordance with the law, and carries out joint special enforcement campaigns with the Ministry of Commerce.
- Ministry of State Security (MSS): Conducts intelligence monitoring and risk assessment for exports of high-performance detection and sensing equipment involving national security, and participates in investigations of sensitive export cases.
- Ministry of Industry and Information Technology (MIIT): Jointly issues dual-use item export control lists with the Ministry of Commerce and participates in export control reviews in the military-civil fusion sector.
